With reference to the Appellant’s contention that the Appellant is not subject to the regime of the 1993 Rules for the reason that units are not securities and issuer is not a body corporate, Shri Barua submitted that this contention cannot be raised in the appeal, as it was not raised before the inspection team or the adjudicating officer. He refuted the Appellant’s contention that the rules are not applicable to the Appellant in the instant case. Shri Barua referred to the definition of the expression "security" in the SCR Act and submitted that the units issued by mutual funds are securities.
